1. Acceptance of Terms

By accessing or using LocumMY ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Platform. These Terms apply to all users, including healthcare workers and clinic employers.

2. Platform Description

LocumMY is a digital marketplace connecting qualified healthcare workers (dental surgery assistants, nurses, dentists, and medical doctors) with dental and medical clinics in Malaysia seeking locum staff. LocumMY is a technology intermediary only and is not an employer or employment agency.

3. User Accounts

You must register with accurate information and maintain the confidentiality of your account credentials. You are responsible for all activity under your account. You must be at least 18 years old and legally permitted to work in Malaysia to register as a healthcare worker.

  • Workers must hold valid professional qualifications and registrations applicable to their role.
  • Clinics must be a legally registered business entity in Malaysia.
  • You must notify us immediately of any unauthorised account access.
  • For your security, your session will be automatically terminated after 15 minutes of inactivity. You will be required to log in again to continue.
Age Requirement & Misrepresentation Warning: Under the Children and Young Persons (Employment) Act 1966 (Act 35), healthcare work is classified as hazardous work and is restricted to persons aged 18 and above. Persons below 18 are strictly prohibited from registering on or using this Platform. By creating an account, you declare that you are 18 years of age or older. Any misrepresentation of age constitutes a false declaration and may: (a) render any agreement formed through this Platform voidable under the Contracts Act 1950 (Act 136); (b) constitute an offence under the Penal Code (Act 574), including but not limited to Section 415 (Cheating); and (c) result in immediate account termination and referral of the matter to the Department of Labour Malaysia or other relevant authorities. LocumMY does not verify users' IC or identity documents at the point of registration. You are solely responsible for the accuracy of the age declaration made during signup.

4. For Healthcare Workers

LocumMY is and will always be free for DSA, nurses, dentists, and medical doctors. Workers are solely responsible for verifying the legitimacy of clinics before accepting a locum engagement. Payment terms, rate, and working conditions are agreed directly between the worker and the clinic — LocumMY is not party to this agreement.

APC Verification & Validity: Doctors and Dentists must submit a valid Annual Practising Certificate (APC) and be approved by our admin team before applying for any jobs. It is your sole and continuing responsibility to hold a current APC. Upon approval we record the certificate's validity (expiry) date, which is displayed on your profile to clinics. When that date passes, your account is automatically locked from applying for new jobs until you upload a current APC and it is re-approved. Our review is a good-faith document check only and does not constitute official verification with, or endorsement by, the Malaysian Medical Council (MMC), the Malaysian Dental Council (MDC), or any regulatory authority. LocumMY does not guarantee the authenticity, currency, or accuracy of any credential, and bears no liability for any engagement undertaken by a worker whose credential is invalid, lapsed, suspended, or revoked. Submitting a forged, altered, or fraudulent certificate is a serious violation that will result in immediate account termination and may be referred to the relevant authorities.

LocumMY does not process or guarantee worker payment. Any payment disputes are between the worker and the clinic.

Cancellation: Pending applications cannot be withdrawn. Confirmed (hired) jobs may be cancelled by the worker via the Job History screen before the job date.

No-Show Policy: If a worker fails to attend a confirmed locum engagement, the clinic may record a No Show against the worker's account. Accumulating 3 no-show reports within any 90-day period will result in an automatic 5-day account suspension, during which the worker cannot apply for or accept new jobs. The no-show count resets after each suspension cycle. Repeated no-shows may result in permanent account termination at LocumMY's discretion.

5. For Clinics (Employers)

Clinics receive a 60-day free trial upon registration. Continued access after the trial requires an active subscription (RM11/month or RM120/year). Clinics must only post genuine, legal locum positions. Job postings that are misleading, discriminatory, or illegal are strictly prohibited and will result in immediate account termination.

No Show Reporting: The "Mark No Show" button must only be used when a confirmed worker genuinely failed to attend on the job date without prior notice. This action directly affects the worker's account standing and may lead to their suspension. Misuse of this feature — including marking a worker as no-show out of spite, disagreement over pay, or any reason unrelated to actual non-attendance — is considered a serious violation of these Terms and may result in the clinic's account being suspended or terminated.

Accidental No Show: If a no-show was recorded by mistake, the clinic must contact LocumMY immediately at support@locumclinicmy.com with the subject line "No Show Correction". Include the worker's name, the Worker ID displayed next to their name on the applicant card (format: ID·XXXXXX), and the date of the job. Our team will locate the exact record and correct it promptly. LocumMY reserves the right to reverse any no-show report found to be inaccurate or made in bad faith.

6. Prohibited Conduct

You agree not to: misrepresent your qualifications or identity; post false or misleading job listings; use the Platform for purposes other than locum employment; attempt to circumvent the Platform to avoid applicable fees; engage in harassment, spam, or abusive behaviour toward other users.

6a. Subscription, Cancellation & Refund Policy

This policy applies to clinic (employer) subscriptions only. Healthcare workers are not charged and this section does not apply to them.

  • Free Trial: All new clinics receive a 60-day free trial. No payment is required during the trial period.
  • Subscription Plans: Monthly plan at RM11/month, or Annual plan at RM120/year.
  • Cancellation: You may cancel your subscription at any time from the Subscription screen within the app. Upon cancellation, your access continues until the end of the current billing period. No further charges will be made after cancellation.
  • Refunds: Subscription fees are non-refundable. No refunds are provided for partial billing periods, unused days, or unused features. This applies to both monthly and annual plans.
  • Failed Payments: If a payment fails, your subscription will be marked as expired and access to clinic features will be suspended until payment is successfully processed.
  • Price Changes: We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect.

7. Limitation of Liability

LocumMY provides the Platform "as is" without warranties of any kind. We are not liable for any disputes between workers and clinics, including but not limited to non-payment, workplace injury, or professional misconduct. Our total liability shall not exceed the amount you paid to LocumMY in the 3 months preceding the claim.

7a. Independent Contractor Relationship

LocumMY is a technology platform that facilitates connections between independent healthcare workers and clinic employers. The relationship between a locum worker and a clinic is that of an independent contractor and client — not employer and employee. LocumMY is not a party to any agreement formed between a worker and a clinic, and does not direct, supervise, or control the clinical work performed.

  • Workers are responsible for their own tax obligations, EPF/SOCSO (where applicable), and professional compliance.
  • Clinics are responsible for ensuring a safe working environment and fulfilling agreed payment terms.
  • Neither party may represent LocumMY as their employer or agent.

7b. Professional Indemnity & Malpractice Insurance

All healthcare workers are solely responsible for maintaining valid professional indemnity and malpractice insurance coverage for every locum engagement undertaken through the Platform. LocumMY does not provide, arrange, verify, or guarantee any professional liability or indemnity coverage for any party.

Medical doctors and dentists practising as locums in Malaysia are strongly advised to maintain active coverage with a recognised provider, including but not limited to:

  • MPS — Medical Protection Society
  • MDU — Medical Defence Union
  • MMI — Malaysian Medical Indemnity

LocumMY does not verify, require proof of, or monitor insurance status. By using the Platform, each healthcare worker represents that they hold adequate professional indemnity coverage for all engagements they accept.

LocumMY accepts no liability for clinical decisions, patient outcomes, negligence claims, or professional misconduct arising from any locum engagement facilitated through the Platform. All such liability rests solely with the individual practitioner and the clinic.

Clinics are responsible for ensuring any locum they engage holds appropriate and current professional indemnity coverage before the engagement begins. LocumMY bears no responsibility for verifying this.

7c. Dispute Resolution

If a dispute arises between a worker and a clinic — including non-payment, no-show disputes, or professional conduct — the parties are encouraged to resolve it directly and in good faith first.

If direct resolution fails, either party may submit a formal dispute report through the Help & Support section of the app. LocumMY will review the report and may, at its sole discretion, take action including suspension or termination of accounts found to be in violation of these Terms.

LocumMY is a neutral matching platform and does not adjudicate disputes or guarantee outcomes. Our role is limited to enforcement of these Terms of Use.

7d. Off-Platform Communication

Users may choose to exchange personal contact details — including phone numbers or WhatsApp — with other users outside this Platform, at their own discretion. LocumMY does not facilitate, endorse, or take any responsibility for any communication, agreement, arrangement, payment, or incident arising from off-platform contact between users. Any arrangement made outside the Platform is solely between the parties involved. LocumMY expressly disclaims all liability in connection therewith.

8. Account Termination & Data Deletion

You may delete your account at any time. Upon deletion request, your account will be immediately deactivated. Personal data will be retained for 6 months for legal compliance purposes before being permanently deleted. See our Privacy Policy for full details.

9. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia. If any provision is found unenforceable, the remaining provisions continue in full effect.

1. Penerimaan Terma

Dengan mengakses atau menggunakan LocumMY ("Platform"), anda bersetuju untuk terikat dengan Terma Penggunaan ini. Sekiranya anda tidak bersetuju, anda tidak dibenarkan menggunakan Platform. Terma ini terpakai kepada semua pengguna, termasuk pekerja kesihatan dan majikan klinik.

2. Penerangan Platform

LocumMY ialah pasaran digital yang menghubungkan pekerja kesihatan yang berkelayakan (pembantu pembedahan pergigian, jururawat, doktor gigi, dan doktor perubatan) dengan klinik pergigian dan perubatan di Malaysia yang memerlukan kakitangan locum. LocumMY adalah perantara teknologi semata-mata dan bukan majikan atau agensi pekerjaan.

3. Akaun Pengguna

Anda mesti mendaftar dengan maklumat yang tepat dan mengekalkan kerahsiaan kelayakan akaun anda. Anda bertanggungjawab ke atas semua aktiviti di bawah akaun anda. Anda mesti berumur sekurang-kurangnya 18 tahun dan dibenarkan secara sah untuk bekerja di Malaysia bagi mendaftar sebagai pekerja kesihatan.

  • Pekerja mesti memegang kelayakan profesional dan pendaftaran yang sah yang berkenaan dengan peranan mereka.
  • Klinik mesti merupakan entiti perniagaan yang berdaftar secara sah di Malaysia.
  • Anda mesti memaklumkan kami dengan serta-merta sekiranya berlaku akses akaun tanpa kebenaran.
  • Bagi keselamatan anda, sesi anda akan ditamatkan secara automatik selepas 15 minit ketidakaktifan. Anda dikehendaki log masuk semula untuk meneruskan.
Syarat Umur & Amaran Maklumat Palsu: Di bawah Akta Kanak-Kanak dan Orang Muda (Pekerjaan) 1966 (Akta 35), kerja penjagaan kesihatan diklasifikasikan sebagai kerja berbahaya dan terhad kepada orang yang berumur 18 tahun ke atas. Orang yang berumur bawah 18 tahun dilarang sama sekali mendaftar atau menggunakan Platform ini. Dengan mencipta akaun, anda mengisytiharkan bahawa anda berumur 18 tahun ke atas. Sebarang salah nyataan mengenai umur merupakan pengisytiharan palsu dan boleh: (a) menjadikan sebarang perjanjian yang dibentuk melalui Platform ini boleh dibatalkan di bawah Akta Kontrak 1950 (Akta 136); (b) merupakan kesalahan di bawah Kanun Keseksaan (Akta 574), termasuk tetapi tidak terhad kepada Seksyen 415 (Penipuan); dan (c) mengakibatkan penamatan akaun dengan serta-merta dan rujukan perkara kepada Jabatan Tenaga Kerja Malaysia atau pihak berkuasa yang berkaitan. LocumMY tidak mengesahkan IC atau dokumen pengenalan pengguna semasa pendaftaran. Anda bertanggungjawab sepenuhnya ke atas ketepatan pengisytiharan umur yang dibuat semasa mendaftar.

4. Untuk Pekerja Kesihatan

LocumMY adalah dan akan sentiasa percuma untuk pembantu pembedahan pergigian, jururawat, doktor gigi, dan doktor perubatan. Pekerja bertanggungjawab sepenuhnya untuk mengesahkan kesahihan klinik sebelum menerima penglibatan locum. Terma pembayaran, kadar, dan syarat kerja dipersetujui secara langsung antara pekerja dan klinik — LocumMY bukan pihak dalam perjanjian ini.

LocumMY tidak memproses atau menjamin pembayaran pekerja. Sebarang pertikaian pembayaran adalah antara pekerja dan klinik.

Pembatalan: Permohonan yang tertangguh tidak boleh ditarik balik. Pekerjaan yang telah disahkan (diambil bekerja) boleh dibatalkan oleh pekerja melalui skrin Sejarah Pekerjaan sebelum tarikh pekerjaan.

Dasar No-Show: Sekiranya pekerja gagal hadir untuk penglibatan locum yang telah disahkan, klinik boleh merekodkan No Show terhadap akaun pekerja. Pengumpulan 3 laporan no-show dalam mana-mana tempoh 90 hari akan mengakibatkan penggantungan akaun automatik selama 5 hari, di mana pekerja tidak boleh memohon atau menerima pekerjaan baharu. Kiraan no-show ditetapkan semula selepas setiap kitaran penggantungan. No-show berulang boleh mengakibatkan penamatan akaun kekal atas budi bicara LocumMY.

5. Untuk Klinik (Majikan)

Klinik menerima percubaan percuma 60 hari selepas pendaftaran. Akses berterusan selepas percubaan memerlukan langganan aktif (RM11/bulan atau RM120/tahun). Klinik mesti hanya menyiarkan jawatan locum yang tulen dan sah. Iklan pekerjaan yang mengelirukan, mendiskriminasi, atau menyalahi undang-undang adalah dilarang sama sekali dan akan mengakibatkan penamatan akaun dengan serta-merta.

Pelaporan No Show: Butang "Mark No Show" hanya boleh digunakan apabila pekerja yang telah disahkan benar-benar gagal hadir pada tarikh pekerjaan tanpa notis terlebih dahulu. Tindakan ini secara langsung menjejaskan kedudukan akaun pekerja dan boleh menyebabkan penggantungan mereka. Penyalahgunaan ciri ini — termasuk menandakan pekerja sebagai no-show atas dasar dendam, pertikaian gaji, atau sebarang sebab yang tidak berkaitan dengan ketidakhadiran sebenar — dianggap sebagai pelanggaran serius Terma ini dan boleh mengakibatkan akaun klinik digantung atau ditamatkan.

No Show Tidak Sengaja: Sekiranya rekod no-show dibuat secara tidak sengaja, klinik mesti segera menghubungi LocumMY di support@locumclinicmy.com dengan tajuk "No Show Correction". Sertakan nama pekerja, ID Pekerja yang dipaparkan di sebelah nama mereka pada kad pemohon (format: ID·XXXXXX), dan tarikh pekerjaan. Pasukan kami akan mengesan rekod yang tepat dan membetulkannya dengan segera. LocumMY berhak untuk membalikkan sebarang laporan no-show yang didapati tidak tepat atau dibuat dengan niat jahat.

6. Tingkah Laku Dilarang

Anda bersetuju untuk tidak: mengelirukan kelayakan atau identiti anda; menyiarkan iklan pekerjaan yang palsu atau mengelirukan; menggunakan Platform untuk tujuan selain pekerjaan locum; cuba memintas Platform untuk mengelak yuran yang berkenaan; terlibat dalam gangguan, spam, atau tingkah laku kasar terhadap pengguna lain.

6a. Polisi Langganan, Pembatalan & Bayaran Balik

Polisi ini terpakai kepada langganan klinik (majikan) sahaja. Pekerja kesihatan tidak dikenakan bayaran dan bahagian ini tidak terpakai kepada mereka.

  • Percubaan Percuma: Semua klinik baharu menerima percubaan percuma 60 hari. Tiada pembayaran diperlukan semasa tempoh percubaan.
  • Pelan Langganan: Pelan Bulanan pada RM11/bulan, atau Pelan Tahunan pada RM120/tahun.
  • Pembatalan: Anda boleh membatalkan langganan anda pada bila-bila masa dari skrin Langganan dalam aplikasi. Selepas pembatalan, akses anda berterusan sehingga akhir tempoh pengebilan semasa. Tiada caj lanjut akan dikenakan selepas pembatalan.
  • Bayaran Balik: Yuran langganan tidak boleh dikembalikan. Tiada bayaran balik diberikan untuk tempoh pengebilan separa, hari tidak digunakan, atau ciri yang tidak digunakan. Ini terpakai kepada kedua-dua pelan bulanan dan tahunan.
  • Pembayaran Gagal: Sekiranya pembayaran gagal, langganan anda akan ditandakan sebagai tamat tempoh dan akses kepada ciri klinik akan digantung sehingga pembayaran berjaya diproses.
  • Perubahan Harga: Kami berhak untuk mengubah harga langganan. Pelanggan sedia ada akan diberitahu sekurang-kurangnya 30 hari sebelum sebarang perubahan harga berkuat kuasa.

7. Had Liabiliti

LocumMY menyediakan Platform "sebagaimana adanya" tanpa sebarang jaminan. Kami tidak bertanggungjawab ke atas sebarang pertikaian antara pekerja dan klinik, termasuk tetapi tidak terhad kepada tidak membayar, kecederaan di tempat kerja, atau salah laku profesional. Jumlah liabiliti kami tidak akan melebihi jumlah yang anda bayar kepada LocumMY dalam tempoh 3 bulan sebelum tuntutan.

7a. Hubungan Kontraktor Bebas

LocumMY adalah platform teknologi yang memudahkan hubungan antara pekerja kesihatan bebas dan majikan klinik. Hubungan antara pekerja locum dan klinik adalah hubungan antara kontraktor bebas dan pelanggan — bukan majikan dan pekerja. LocumMY bukan pihak dalam sebarang perjanjian yang dibentuk antara pekerja dan klinik, dan tidak mengarah, menyelia, atau mengawal kerja klinikal yang dilaksanakan.

  • Pekerja bertanggungjawab ke atas kewajipan cukai mereka sendiri, KWSP/PERKESO (di mana berkenaan), dan pematuhan profesional.
  • Klinik bertanggungjawab untuk memastikan persekitaran kerja yang selamat dan memenuhi terma pembayaran yang dipersetujui.
  • Mana-mana pihak tidak boleh mewakili LocumMY sebagai majikan atau ejen mereka.

7b. Indemniti Profesional & Insurans Malpraktis

Semua pekerja kesihatan bertanggungjawab sepenuhnya untuk mengekalkan liputan indemniti profesional dan insurans malpraktis yang sah bagi setiap penglibatan locum yang dilaksanakan melalui Platform. LocumMY tidak menyediakan, mengatur, mengesahkan, atau menjamin sebarang liputan liabiliti atau indemniti profesional untuk mana-mana pihak.

Doktor perubatan dan doktor gigi yang berkhidmat sebagai locum di Malaysia sangat dinasihatkan untuk mengekalkan liputan aktif dengan pembekal yang diiktiraf, termasuk tetapi tidak terhad kepada:

  • MPS — Medical Protection Society
  • MDU — Medical Defence Union
  • MMI — Malaysian Medical Indemnity

LocumMY tidak mengesahkan, tidak memerlukan bukti, atau memantau status insurans. Dengan menggunakan Platform, setiap pekerja kesihatan mengakui bahawa mereka memegang liputan indemniti profesional yang mencukupi bagi semua penglibatan yang mereka terima.

LocumMY tidak menerima sebarang liabiliti ke atas keputusan klinikal, hasil rawatan pesakit, tuntutan kecuaian, atau salah laku profesional yang timbul daripada sebarang penglibatan locum yang difasilitasi melalui Platform. Semua liabiliti tersebut terletak sepenuhnya pada pengamal individu dan klinik.

Klinik bertanggungjawab untuk memastikan mana-mana locum yang mereka libatkan memegang liputan indemniti profesional yang sesuai dan terkini sebelum penglibatan bermula. LocumMY tidak bertanggungjawab untuk mengesahkan perkara ini.

7c. Penyelesaian Pertikaian

Sekiranya timbul pertikaian antara pekerja dan klinik — termasuk tidak membayar, pertikaian no-show, atau kelakuan profesional — pihak-pihak digalakkan untuk menyelesaikannya secara langsung dan dengan niat baik terlebih dahulu.

Sekiranya penyelesaian langsung gagal, mana-mana pihak boleh menghantar laporan pertikaian rasmi melalui bahagian Bantuan & Sokongan dalam aplikasi. LocumMY akan menyemak laporan tersebut dan boleh, atas budi bicaranya sendiri, mengambil tindakan termasuk penggantungan atau penamatan akaun yang didapati melanggar Terma ini.

LocumMY adalah platform pemadanan neutral dan tidak menghakimi pertikaian atau menjamin sebarang keputusan. Peranan kami terhad kepada penguatkuasaan Terma Penggunaan ini.

7d. Komunikasi Di Luar Platform

Pengguna boleh memilih untuk berkongsi maklumat hubungan peribadi — termasuk nombor telefon atau WhatsApp — dengan pengguna lain di luar Platform ini, atas budi bicara mereka sendiri. LocumMY tidak memudahkan, menyokong, atau bertanggungjawab atas sebarang komunikasi, perjanjian, urusan, pembayaran, atau insiden yang timbul daripada hubungan di luar Platform antara pengguna. Sebarang urusan yang dibuat di luar Platform adalah semata-mata antara pihak-pihak yang terlibat. LocumMY menafikan semua liabiliti berkenaan dengannya.

8. Penamatan Akaun & Pemadaman Data

Anda boleh memadamkan akaun anda pada bila-bila masa. Selepas permintaan pemadaman, akaun anda akan dinonaktifkan dengan serta-merta. Data peribadi akan disimpan selama 6 bulan bagi tujuan pematuhan undang-undang sebelum dipadamkan secara kekal. Sila rujuk Dasar Privasi kami untuk butiran penuh.

9. Undang-Undang Pentadbiran

Terma ini ditadbir oleh undang-undang Malaysia. Sebarang pertikaian tertakluk kepada bidang kuasa eksklusif mahkamah Malaysia. Sekiranya mana-mana peruntukan didapati tidak boleh dikuatkuasakan, peruntukan-peruntukan yang selebihnya terus berkuat kuasa sepenuhnya.

LocumMY ("we", "us", "our") acts as the Data Controller for personal data collected through this Platform, as defined under the Personal Data Protection Act 2010 (as amended by the Amendment Act 2024). As Data Controller, we determine the purposes and means of processing your personal data and are accountable for handling it in compliance with Malaysian data protection law.

1. Information We Collect

We collect information you provide directly, including:

  • Account data: name, email address, phone number, professional category, and location. Your phone number is collected to verify your identity via SMS one-time password (OTP) during registration and to prevent duplicate accounts from being created with the same number.
  • Profile data: experience level, bio, availability dates, and optional profile photo.
  • Clinic data: clinic name, business registration, type, and contact information.
  • Usage data: pages visited, features used, and device information (browser type, OS).
  • Communications: messages sent through the Platform's messaging feature.
  • Push notification token: a device-specific token (FCM token) generated when you enable push notifications, used solely to deliver job alerts and updates to your device.
  • Verification documents (temporary): professional certificates (APC) submitted by doctors and dentists, and business registration certificates submitted by clinics. These documents are uploaded solely for identity and credential verification. The document images are permanently and automatically deleted from our systems immediately after our admin team completes the review — whether approved or rejected. They are never retained, shared, or stored beyond the review process. For APC submissions only, we retain the certificate's validity (expiry) date read during review — this single date is used to display your APC validity to clinics and to lock applications once it lapses. We do not retain the APC document image, the APC number, or any other content from it.

2. How We Use Your Information

Your information is used to: operate and improve the Platform; match workers with suitable job opportunities; allow clinics to contact and hire workers; send transactional emails (application updates, hire confirmations, account alerts); verify your phone number via SMS one-time password (OTP) during registration to confirm ownership and prevent fraudulent account creation; process subscription payments; and comply with Malaysian law.

We do not sell your personal data to third parties. Ever.

3. Data Sharing

Your profile information (name, email address, category, location, and experience) is visible to verified registered clinics on the Platform. Your phone number is stored privately and is never visible to other users or clinics — it is accessible only by you and LocumMY administrators. We share data with:

  • Firebase / Google Cloud (Google) — authentication (including SMS one-time password delivery during registration), database, and server-side processing. Data is stored and processed in the Asia Pacific (Singapore) region.
  • Google Cloud Storage — encrypted database backups, stored in the Asia Pacific region.
  • Cloudflare — content delivery network and DDoS protection.
  • Chip-in — payment processing (card/FPX). Payment card data is handled entirely by Chip-in and never passes through LocumMY's systems.
  • Brevo (Sendinblue) — transactional email delivery (e.g. hire confirmations, account alerts).

All third-party services are bound by data processing agreements and may not use your data for their own purposes.

All cross-border data transfers comply with the requirements of the PDPA 2010 (as amended 2024). We only transfer your personal data to jurisdictions that provide an equivalent level of data protection, or where appropriate contractual safeguards are in place.

4. Data Retention & Deletion

We retain different types of data for different periods depending on their purpose:

  • Job postings — Expired or cancelled job listings are automatically removed from our systems after 3 days.
  • Job applications (unsuccessful) — Pending, declined, or cancelled applications are automatically deleted after 3 days from the job date.
  • Job applications (hired) — Completed engagements where a worker was hired are retained indefinitely to preserve accurate work history and statistics for both workers and clinics.
  • Verification documents (APC & clinic certificates) — Permanently deleted from our storage immediately after admin review is completed, regardless of outcome (approved or rejected). These documents are never retained beyond the review process.
  • Messages — Conversation messages are automatically deleted after 30 days from the date of sending, regardless of account status.

When you request account deletion:

  • Your account is immediately deactivated and hidden from all users.
  • Your personal data is retained for 6 months for legal compliance and dispute resolution purposes.
  • After 6 months, all personal data is permanently and irreversibly deleted from our systems.
  • You may contact support to reactivate your account within the 6-month window.

5. Your Rights (PDPA 2010 & 2024 Amendment)

Under Malaysia's Personal Data Protection Act 2010 (as amended 2024), you have the following rights:

  • Access — You may request a copy of the personal data we hold about you.
  • Correction — You may request that inaccurate or incomplete personal data be corrected.
  • Withdraw consent — You may withdraw consent to data processing at any time. Note: this may affect your ability to use the Platform.
  • Deletion — You may request deletion of your personal data, subject to our 6-month legal retention period following an account deletion request.
  • Data portability — Under the 2024 Amendment, you have the right to request that your personal data be transferred to another service provider, where technically feasible.

To exercise any of these rights, contact us at support@locumclinicmy.com. We will respond within 21 days.

5a. Data Accuracy

We take reasonable steps to ensure personal data we hold is accurate, complete, and up to date — in compliance with the Data Integrity Principle under the PDPA. You are responsible for keeping your profile information current. You may update your name, profile photo, availability, and other details at any time through the My Profile screen. If you believe any data we hold about you is inaccurate, please contact us at support@locumclinicmy.com and we will correct it promptly.

6. Cookies & Local Storage

LocumMY uses browser local storage (not cookies) to save the following data locally on your device:

  • Theme preference — light or dark mode setting.
  • Saved jobs — jobs you have bookmarked, stored only on your device.
  • Push notification token (FCM token) — stored locally to avoid unnecessary re-registration on each login. This token is also saved to your account on our servers and is removed when you log out or disable notifications.

Local storage data (other than the FCM token) is never transmitted to our servers.

7. Security

We implement multiple layers of security to protect your data:

  • HTTPS encryption — all data in transit is encrypted via TLS. HTTP is automatically redirected to HTTPS.
  • Firebase App Check — only verified instances of the LocumMY app can access our database. Unauthorised API access is blocked.
  • Firestore Security Rules — every database read and write is governed by strict access rules. Users can only access data they are authorised to see.
  • Server-side enforcement — critical business rules (such as no-show recording and account deletion) are enforced on our servers via Cloud Functions, not just in the app. They cannot be bypassed.
  • Protected fields — sensitive account fields (such as your role, verification status, and subscription status) can only be modified by our administrators — never by you or anyone else directly.
  • Cloudflare WAF — our infrastructure is protected by a Web Application Firewall that filters malicious traffic before it reaches our servers.
  • Error monitoring — our team receives automated alerts for any unexpected system errors, allowing us to respond quickly.
  • Automated security testing — access control rules, authentication checks, and input validation are continuously verified through a suite of automated tests to ensure they function correctly at all times.
  • Phone number verification — account registration requires SMS one-time password (OTP) verification to confirm you own the phone number you register with. Your phone number is stored in a private, access-restricted database that no other user or clinic can access.
  • Session auto-timeout — your session is automatically terminated after 15 minutes of inactivity to prevent unauthorised access on shared or unattended devices.
  • Reliable email delivery — all transactional emails (hire confirmations, alerts) are sent with automatic retry on failure to ensure important notifications reach you.
  • Automated database backup — all user data is automatically backed up twice daily (6 AM and 6 PM MYT) to Google Cloud Storage in the Singapore region, ensuring data can be recovered in the event of any system failure.
  • Breach notification — In the event of a personal data breach, we will notify the Personal Data Protection Department (JPDP) as required under the PDPA Amendment Act 2024. If the breach is likely to result in significant harm to you, we will also notify you promptly via your registered email address.

However, no system is 100% secure. Please use a strong, unique password and keep your email verified.

LocumMY ("kami") bertindak sebagai Pengawal Data bagi data peribadi yang dikumpulkan melalui Platform ini, sebagaimana yang ditakrifkan di bawah Akta Perlindungan Data Peribadi 2010 (sebagaimana dipinda oleh Akta Pindaan 2024). Sebagai Pengawal Data, kami bertanggungjawab menentukan tujuan dan cara pemprosesan data peribadi anda serta memastikan ia dikendalikan selaras dengan undang-undang perlindungan data Malaysia.

1. Maklumat Yang Kami Kumpulkan

Kami mengumpulkan maklumat yang anda berikan secara langsung, termasuk:

  • Data akaun: nama, alamat e-mel, nombor telefon, kategori profesional, dan lokasi. Nombor telefon anda dikumpulkan untuk mengesahkan identiti anda melalui kata laluan satu masa (OTP) SMS semasa pendaftaran dan untuk mencegah penciptaan akaun pendua dengan nombor yang sama.
  • Data profil: tahap pengalaman, bio, tarikh ketersediaan, dan gambar profil pilihan.
  • Data klinik: nama klinik, pendaftaran perniagaan, jenis, dan maklumat hubungan.
  • Data penggunaan: halaman yang dilawati, ciri yang digunakan, dan maklumat peranti (jenis pelayar, sistem pengendalian).
  • Komunikasi: mesej yang dihantar melalui ciri pemesejan Platform.
  • Token pemberitahuan tolak: token khusus peranti (token FCM) yang dijana apabila anda mendayakan pemberitahuan tolak, digunakan semata-mata untuk menghantar amaran pekerjaan dan kemas kini ke peranti anda.
  • Dokumen pengesahan (sementara): sijil profesional (APC) yang diserahkan oleh doktor dan doktor gigi, serta sijil pendaftaran perniagaan yang diserahkan oleh klinik. Dokumen-dokumen ini dimuat naik semata-mata untuk tujuan pengesahan identiti dan kelayakan. Dokumen tersebut dipadamkan secara kekal dan automatik daripada sistem kami serta-merta selepas pasukan pentadbir kami menyelesaikan semakan — sama ada diluluskan atau ditolak. Dokumen ini tidak pernah disimpan, dikongsi, atau dikekalkan melebihi proses semakan.

2. Cara Kami Menggunakan Maklumat Anda

Maklumat anda digunakan untuk: mengendalikan dan meningkatkan Platform; memadankan pekerja dengan peluang pekerjaan yang sesuai; membolehkan klinik menghubungi dan mengambil pekerja; menghantar e-mel transaksi (kemas kini permohonan, pengesahan pengambilan, amaran akaun); mengesahkan nombor telefon anda melalui OTP SMS semasa pendaftaran bagi mengesahkan pemilikan dan mencegah penciptaan akaun penipuan; memproses pembayaran langganan; dan mematuhi undang-undang Malaysia.

Kami tidak menjual data peribadi anda kepada pihak ketiga. Sesekali pun tidak.

3. Perkongsian Data

Maklumat profil anda (nama, alamat e-mel, kategori, lokasi, dan pengalaman) boleh dilihat oleh klinik berdaftar yang telah disahkan di Platform. Nombor telefon anda disimpan secara peribadi dan tidak pernah didedahkan kepada pengguna lain atau klinik — ia hanya boleh diakses oleh anda dan pentadbir LocumMY. Kami berkongsi data dengan:

  • Firebase / Google Cloud (Google) — pengesahan (termasuk penghantaran OTP SMS semasa pendaftaran), pangkalan data, dan pemprosesan sebelah pelayan. Data disimpan dan diproses di rantau Asia Pasifik (Singapura).
  • Google Cloud Storage — sandaran pangkalan data yang disulitkan, disimpan di rantau Asia Pasifik.
  • Cloudflare — rangkaian penghantaran kandungan dan perlindungan DDoS.
  • Chip-in — pemprosesan pembayaran (kad/FPX). Data kad pembayaran dikendalikan sepenuhnya oleh Chip-in dan tidak pernah melalui sistem LocumMY.
  • Brevo (Sendinblue) — penghantaran e-mel transaksi (cth: pengesahan pengambilan, amaran akaun).

Semua perkhidmatan pihak ketiga terikat dengan perjanjian pemprosesan data dan tidak dibenarkan menggunakan data anda untuk tujuan mereka sendiri.

Semua pemindahan data rentas sempadan mematuhi keperluan Akta Perlindungan Data Peribadi 2010 (sebagaimana dipinda 2024). Kami hanya memindahkan data peribadi anda ke bidang kuasa yang menyediakan tahap perlindungan data yang setara, atau di mana perlindungan kontraktual yang sesuai telah ditetapkan.

4. Penyimpanan & Pemadaman Data

Kami menyimpan pelbagai jenis data untuk tempoh yang berbeza bergantung kepada tujuannya:

  • Iklan pekerjaan — Senarai pekerjaan yang tamat tempoh atau dibatalkan dipadamkan secara automatik daripada sistem kami selepas 3 hari.
  • Permohonan pekerjaan (tidak berjaya) — Permohonan yang tertangguh, ditolak, atau dibatalkan dipadamkan secara automatik selepas 3 hari dari tarikh pekerjaan.
  • Permohonan pekerjaan (diambil bekerja) — Penglibatan yang telah selesai di mana pekerja telah diambil bekerja disimpan selama-lamanya bagi memelihara rekod sejarah kerja dan statistik yang tepat untuk pekerja dan klinik.
  • Dokumen pengesahan (APC & sijil klinik) — Dipadamkan secara kekal daripada storan kami serta-merta selepas semakan pentadbir selesai, tanpa mengira keputusan (diluluskan atau ditolak). Dokumen ini tidak pernah disimpan melebihi proses semakan.
  • Mesej — Mesej perbualan dipadamkan secara automatik selepas 30 hari dari tarikh penghantaran, tanpa mengira status akaun.

Apabila anda meminta pemadaman akaun:

  • Akaun anda dinonaktifkan serta-merta dan disembunyikan daripada semua pengguna.
  • Data peribadi anda disimpan selama 6 bulan bagi tujuan pematuhan undang-undang dan penyelesaian pertikaian.
  • Selepas 6 bulan, semua data peribadi dipadamkan secara kekal dan tidak boleh dipulihkan daripada sistem kami.
  • Anda boleh menghubungi sokongan untuk mengaktifkan semula akaun anda dalam tempoh 6 bulan tersebut.

5. Hak Anda (Akta Perlindungan Data Peribadi 2010 & Pindaan 2024)

Di bawah Akta Perlindungan Data Peribadi 2010 (sebagaimana dipinda 2024), anda mempunyai hak-hak berikut:

  • Akses — Anda boleh meminta salinan data peribadi yang kami simpan tentang anda.
  • Pembetulan — Anda boleh meminta agar data peribadi yang tidak tepat atau tidak lengkap diperbetulkan.
  • Tarik balik persetujuan — Anda boleh menarik balik persetujuan terhadap pemprosesan data pada bila-bila masa. Nota: ini mungkin menjejaskan keupayaan anda menggunakan Platform.
  • Pemadaman — Anda boleh meminta pemadaman data peribadi anda, tertakluk kepada tempoh penyimpanan undang-undang kami selama 6 bulan selepas permintaan pemadaman akaun.
  • Kebolehpindahan data — Di bawah Pindaan 2024, anda berhak meminta agar data peribadi anda dipindahkan kepada pembekal perkhidmatan lain, sekiranya dapat dilaksanakan secara teknikal.

5a. Ketepatan Data

Kami mengambil langkah-langkah yang munasabah untuk memastikan data peribadi yang kami simpan adalah tepat, lengkap, dan terkini — selaras dengan Prinsip Integriti Data di bawah Akta Perlindungan Data Peribadi. Anda bertanggungjawab untuk memastikan maklumat profil anda sentiasa dikemas kini. Anda boleh mengemas kini nama, gambar profil, ketersediaan, dan maklumat lain pada bila-bila masa melalui skrin Profil Saya. Jika anda percaya bahawa mana-mana data yang kami simpan tentang anda adalah tidak tepat, sila hubungi kami di support@locumclinicmy.com dan kami akan membetulkannya dengan segera.

6. Kuki & Storan Tempatan

LocumMY menggunakan storan tempatan pelayar (bukan kuki) untuk menyimpan data berikut secara tempatan di peranti anda:

  • Pilihan tema — tetapan mod cerah atau gelap.
  • Pekerjaan yang disimpan — pekerjaan yang anda tandakan, disimpan hanya di peranti anda.
  • Token pemberitahuan tolak (token FCM) — disimpan secara tempatan bagi mengelakkan pendaftaran semula yang tidak perlu pada setiap log masuk. Token ini turut disimpan dalam akaun anda di pelayan kami dan dipadamkan apabila anda log keluar atau melumpuhkan pemberitahuan.

Data storan tempatan (selain token FCM) tidak pernah dihantar ke pelayan kami.

7. Keselamatan

Kami melaksanakan pelbagai lapisan keselamatan untuk melindungi data anda:

  • Penyulitan HTTPS — semua data dalam transit disulitkan melalui TLS. HTTP dialihkan secara automatik ke HTTPS.
  • Firebase App Check — hanya contoh LocumMY yang disahkan boleh mengakses pangkalan data kami. Akses API tanpa kebenaran disekat.
  • Peraturan Keselamatan Firestore — setiap bacaan dan penulisan pangkalan data dikawal oleh peraturan akses yang ketat. Pengguna hanya boleh mengakses data yang mereka dibenarkan lihat.
  • Penguatkuasaan sebelah pelayan — peraturan perniagaan kritikal (seperti rekod no-show dan pemadaman akaun) dikuatkuasakan di pelayan kami melalui Cloud Functions, bukan semata-mata dalam aplikasi. Ia tidak boleh dipintas.
  • Medan terlindung — medan akaun sensitif (seperti peranan, status pengesahan, dan status langganan anda) hanya boleh diubah suai oleh pentadbir kami — tidak pernah oleh anda atau sesiapa pun secara langsung.
  • Cloudflare WAF — infrastruktur kami dilindungi oleh Tembok Api Aplikasi Web yang menapis trafik berniat jahat sebelum mencapai pelayan kami.
  • Pemantauan ralat — pasukan kami menerima amaran automatik bagi sebarang ralat sistem yang tidak dijangka, membolehkan kami bertindak balas dengan cepat.
  • Ujian keselamatan automatik — peraturan kawalan akses, semakan pengesahan, dan pengesahan input disahkan secara berterusan melalui set ujian automatik bagi memastikan ia berfungsi dengan betul pada setiap masa.
  • Pengesahan nombor telefon — pendaftaran akaun memerlukan pengesahan kata laluan satu masa (OTP) SMS bagi mengesahkan bahawa anda memiliki nombor telefon yang anda daftarkan. Nombor telefon anda disimpan dalam pangkalan data peribadi yang dilindungi dan tidak boleh diakses oleh mana-mana pengguna atau klinik lain.
  • Tamat tempoh sesi automatik — sesi anda ditamatkan secara automatik selepas 15 minit ketidakaktifan bagi mencegah akses tanpa kebenaran pada peranti yang dikongsi atau ditinggalkan.
  • Penghantaran e-mel yang boleh dipercayai — semua e-mel transaksi (pengesahan pengambilan, amaran) dihantar dengan percubaan semula automatik sekiranya gagal bagi memastikan pemberitahuan penting sampai kepada anda.
  • Sandaran pangkalan data automatik — semua data pengguna disandar secara automatik dua kali sehari (6 PG dan 6 PTG WIB) ke Google Cloud Storage di rantau Singapura, bagi memastikan data boleh dipulihkan sekiranya berlaku kegagalan sistem.
  • Pemberitahuan pelanggaran — Sekiranya berlaku pelanggaran data peribadi, kami akan memaklumkan Jabatan Perlindungan Data Peribadi (JPDP) sebagaimana yang dikehendaki di bawah Akta Pindaan Akta Perlindungan Data Peribadi 2024. Sekiranya pelanggaran tersebut berkemungkinan mendatangkan kemudaratan besar kepada anda, kami akan memaklumkan anda dengan segera melalui alamat e-mel berdaftar anda.

Walau bagaimanapun, tiada sistem yang 100% selamat. Sila gunakan kata laluan yang kukuh dan unik, serta pastikan e-mel anda telah disahkan.
